Administrative License Revocation - Upon arrest for DUI, not conviction, a driver’s license will be immediately suspended for seven days if the driver refuses to take the breath test or the results of the breath test indicate a BAC equal to or greater than .08 (greater than or equal to .02 if the driver is under 21 years of age). If the driver is charged with a second offense, the suspension is for 60 days or until time of trial (whichever is less). If the driver is charged with a third or subsequent offense, the suspension is until time of trial.
