How many years have you been in practice? This will tell you a lot about the Lawyer’s potential experience. You want a lawyer who has been the problems with the Government’s case before and knows how to use those problems to gain your acquittal.

What is the last seminar you attended on DUI defense and when did you attend that seminar? DUI defense is not a static profession. New defenses arise all the time and your attorney needs to attend the specialty seminars where such defenses are discussed and explained. Your attorney also needs to belong to a network of DUI defense attorneys to stay current. The Government shares information among prosecutors; your defense attorney should do so as well.
Bob attends at least two DUI seminars a year. These seminars are given all over the country and involve the expense of airfare, hotel and fees for the seminar. The last seminar that Bob attended was in San Antonio, Texas. Bob thinks that being informed of possible defenses for you is worth his investment in time and money. Does the attorney even know the name of the EC/IR II? A lot of people who claim to understand this breath tester do not even know its name. They do not know that the name EC/IR II implies that the machine will measure the subject's alcohol concentration in two methods: EC (electrochemical or fuel cell) and IR (infrared technology). By this method, the device guarantees the reliability of its results through using different tests. This internal corroboration would give the EC/IR II a distinct reliability advantage over devices utilizing only one technology. Unfortunately, Intoximeters was unable to coordinate the different analytical methods. Because of that failure, the instrument does not use two independent methods to measure alcohol concentration. Instead, the EC/IR II uses only the fuel cell to measure alcohol and determine blood alcohol content. The IR is employed only to detect mouth alcohol through a slope detector.
4) Does the attorney have the manufacturer’s manual for the EC/IR II? I am not talking about DFS’s operator’s manual; I am referring to the manual from Intoximeters to Virginia DFS.
If he or she is serious about DUI defense that manual will be on the bookshelf.

Does the attorney routinely order the information on the breath testers used where he practices from DFS? The only way to determine if the breath tester is functioning properly is to carefully review all of its records. The attorney ought to already have or be moving quickly to obtain the IntoxNet MIS reports, the complete Instrument Location History, Complete Instrument Maintenance History, Complete Trouble Call Log, all Certificates of Instrument Accuracy and Uncertainty of Measurement Budget for the particular gadget. A good lawyer has to act as a Quality Control Inspector of the relevant DFS evidentiary breath tester since DFS r hides any problems they find.

Does the attorney routinely keep the arrest warrants made by officers who enforce the DUI laws in the jurisdictions where the attorney practices? 8) What will be the final outcome of my case? A good attorney will
not promise you a specific result because it is impossible to be certain how a case will turn out
. Any other answer is dishonest and unethical. A good attorney can only promise to do his or her best job to protect your interests. NO lawyer wins all his or her cases but it is a certainty that you cannot win an issue your lawyer fails to recognize or fails to raise at trial.
