Virginia Reckless Driving Laws
According to the Virginia Department of Motor Vehicles, (DMV), the following offenses fall under the category of reckless driving and could be considered a misdemeanor or felony depending on the specific incident:

  • Driving 81 mph or more
  • Driving 20 mph or more above the posted speed limit
  • Driving two vehicles abreast
  • Driving too fast for conditions
  • Racing
  • Passing an emergency vehicle
  • Passing a school bus
  • Passing on the crest of a hill
  • Passing at a railroad crossing
  • Passing two vehicles abreast
  • Failing to give a proper signal
  • Driving a vehicle that is not under control; faulty brakes
  • Driving recklessly in parking lots
  • Driving with an obstructed view

The Virginia DMV applies six demerit points to your driving record if you are convicted of reckless driving.  Demerit points will remain on your driving record for two years from the date of the incident, however, the conviction will be reported for up to eleven years.  Your employment, insurance premiums and driving privileges could be greatly impacted by a reckless driving violation.
