Virginia to Diabetics: We Don’t Care

Research indicates that as many as one in seven drivers are diabetic. This figure includes drivers who may be affected but do not have an official diagnosis. Despite this fact, Virginia’s latest breath tester can’t tell the difference between diabetes and intoxication. Now, diabetics who drive in Virginia are being wrongly convicted of DWI. Worse, it appears that Virginia knew about this problem at the time it ordered the machine… and chose to cover it up.

When Virginia initially requested bids for a new evidentiary breath test device to determine blood alcohol content it correctly required the machine to distinguish among alcohols. This requirement was intended to prevent wrongful convictions. When the manufacturer Virginia wanted to hire admitted that its product could not meet this specification, officials quietly dropped the requirement but nonetheless trained operators, taught judges and represented to prosecutors that the machine performed as specified.

Drinking alcohol is called ethanol. Diabetics naturally produce another type of alcohol – isopropanol – in certain stages of the disease. Even though Virginia’s breath tester is only supposed to measure blood alcohol content of ethanol it registers isopropanol on the breath of diabetics. This reading results in false evidence which in turn results in wrongful DWI convictions.

An ancient expression about the measure of a society’s morality is how it treats the sick. Diabetics have enough challenges without the threat of wrongful DWI conviction. Join me in challenging Virginia to cease this shameful practice.

At 6 ft 2 inches, 247 pounds Schmitt can and does generate a great deal of mayhem on the playing field. After graduating from West Virginia, Schmitt was drafted by the Seahawks as a Fullback.

On June 21, 2009 Schmitt was arrested in Washington State for DWI. His BAC was around .15. Schmit was allowed to plead guilty to reckless driving and must perform 24 hours community service, pay $2,000 in fines and costs and remain on probation for two years.

Polk County Florida prosecutors have dropped DWI charges against over 50 suspects due to Deputy Tex Thomas' admissions that he used canned facts and failed to wait the mandatory 20 minutes to ensure accurate breath test results. If the 20 minutes is not followed the suspect may receive an inflated BAC number due to mouth alcohol.

Thomas was not fired and prosecuted for perjury but he was taken off the DUI enforcement squad. I.

First, Bob Battle gets an order to have Thomas Workman inspect an Intoxilyzer 5000 in Fairfax; the government settles that case. Then Jerry Phillips gets to inspect the Intoxilyzer 5000 in Alexandria for Vito Fosella's defense; the machine is in terrible shape. Then Scott Surovell gets several gadgets inspected in Fairfax with an Oscilloscope. What a mess.

And all because the Virginia Department of Forensic Science never used an oscilloscope to test the diagnostic equipment entrusted to it.

According to documents obtained by Bob Keefer:

"The oscilloscope is the most versatile and useful piece of test equipment available to actually see what is going on with both analog and digital circuitry. VIRGINIA ACTS OF ASSEMBLY -- CHAPTERAn Act to amend and reenact § 18.2-272 of the Code of Virginia, relating to penalty for driving without an ignition interlock. [H 1805]Approved

Be it enacted by the General Assembly of Virginia:

1. That § 18.2-272 of the Code of Virginia is amended and reenacted as follows:

§ 18.2-272. Driving after forfeiture of license.

A. Any person who drives or operates any motor vehicle, engine or train in the Commonwealth during the time for which he was deprived of the right to do so (i) upon conviction of a violation of § 18.2-268.3 or of an offense set forth in subsection E of § 18.2-270, (ii) by § 18.2-271 or 46.2-391.2, (iii) after his license has been revoked pursuant to § 46.2-389 or 46.2-391, or (iv) in violation of the terms of a restricted license issued pursuant to subsection E of § 18.2-271.1, is guilty of a Class 1 misdemeanor except as otherwise provided in § 46.2-391, and is subject to administrative revocation of his driver's license pursuant to §§ 46.2-389 and 46.2-391. Any person convicted of three violations of this section committed within a 10-year period is guilty of a Class 6 felony.

Nothing in this section or § 18.2-266, 18.2-270 or 18.2-271, shall be construed as conflicting with or repealing any ordinance or resolution of any city, town or county which restricts still further the right of such persons to drive or operate any such vehicle or conveyance.

B. Regardless of compliance with any other restrictions on his privilege to drive or operate a motor vehicle, it shall be a violation of this section for any person whose privilege to drive or operate a motor vehicle has been restricted, suspended or revoked because of a violation of § 18.2-6.31, 18.2-51.4, 18.2-266, 18.2-268.3, 46.2-341.24, or a similar ordinance or law of another state or the United States to drive or operate a motor vehicle while he has a blood alcohol content of 0.02 percent or more.

Any person suspected of a violation of this subsection shall be entitled to a preliminary breath test in accordance with the provisions of § 18.2-267, shall be deemed to have given his implied consent to have samples of his blood, breath or both taken for analysis pursuant to the provisions of § 18.2-268.2, and, when charged with a violation of this subsection, shall be subject to the provisions of §§ 18.2-268.1 through 18.2-268.12.

C. Any person who drives or operates a motor vehicle without a certified ignition interlock system as required by § 46.2-391.01 is guilty of a Class 1 misdemeanor and is subject to administrative revocation of his driver's license pursuant to §§ 46.2-389 and 46.2-391.

Chris Browning, Chief Investigator for the Alabama Attorney General Troy King, was arrested for DUI on January 24, 2009 for DUI.

Browing had been the AG's chief investigator since January 1, 2007.

Browning had previously been chief of police for Fairhope.

Browning will not receive special treatment according to the AG's office.

Virginia is finally getting rid of its "dated, unstable & unreliable" Intoxilyzer 5000s. The patent application for this gadget was filed in 1983. The processor was the one used to run "Pong".

Judge John F. Kelly, a 65 year old Pima Superior Court Judge, was charged with DUI on December 5, 2008.

Judge Kelly had the misfortune to spell of alcohol at a sobriety checkpoint.

Judge Kelly had demonstrated no signs of impaired driving; he just smelled like he had consumed alcohol.

Judge Kelly’s blood test came back 0.063, a result below the .08 bac legal limit.

The prosecutor has moved to dismiss the charge and I am certain that is appropriate; however, would the state be so quick to dismiss against an ordinary innocent civilian.

I hope so.

I also hope that Judge Kelly remembers how innocent people get arrested for DUI in the new zero tolerance world of DUI enforcement.

Lieutenant Hendrickson, a 47 year old Newport News Police Lieutenant, has been charged with several sex charge felonies in York County, Virginia.

Police Lieutenant Hendrickson was charged on Monday, December 29, 2008 with felony abduction with intent to defile, abduction, penetration with an inanimate object, and misdemeanor sexual battery.

Police Lieutenant Hendrickson is being held at the Virginia Peninsula Regional Jail since the Court decided not to release him on bond given the seriousness of the charges.

Police Lieutenant Hendrickson has been a member of the Newport News Police Department for almost 23 years.

The police department has placed Hendrickson on leave with pay.

I am sure that Police Lieutenant Hendrickson deserves to keep his job with pay while charges are pending and to be treated like he is presumed innocent until proven guilty; however, I just wish ordinary citizens charged with misdemeanor DUI got the same presumption of innocence.

First Sgt. Bryan Hutcheson of the Virginia State Police will have extra state police patrols out to catch drunken New Years parties who choose to drive.

In 2008 17 people have died on Harrisonburg and Rockingham County roadways.

First Sgt. Hutcheson pledged to do what he could to prevent impaird driving that could lead to injuries or death.

The Rockingham County Sheriff Department also announced that they would have increased patrols for New Years Eve.

Harrisonburg Police will also employ saturation patroling to give incentives to party goers not to drive impaired.

Virginia Van Roll Over Lawyer Bob Keefer: Loaded Vans are easy to roll over

Van accidents cause a great deal of death and injury on American roadways. Fifteen-passenger vans typically seat a driver and 14 passengers. They are widely used by community groups, churches, colleges and car pools.

Research conducted by the National Highway Traffic Safety Administration (NHTSA) determined that the risk of a rollover crash is substantially increased with 10 or more passengers in a 15-passenger van. The reason is that passenger weight raises the vehicle’s center of gravity and causes it to shift rearward. Therefore, the van is less resistant to rollover and is more difficult to control in an emergency situation. Roof top loads also raise the center of gravity and increase the chance of a rollover.

A rollover crash is a complicated event. In studies of single-vehicle crashes, NHTSA determined that over 90 percent of rollovers occur after a driver has lost control and run off the road.

NHTSA identified three fact patterns which led to 15-passenger van rollover accidents.

1. The van goes off a road with an unimproved shoulder such as a rural road. The van will overturn when it strikes a ditch or embankment or crosses onto soft soil.

2. The driver is tired or speeding. A fatigued driver is more likely to fall asleep and lose control. Excessive speeds could cause the van to slide sideways, leave the roadway and leave the tires on soft soil.

3. The driver overcorrects the steering when a wheel dropping off the pavement.

80 percent of people killed in rollover crashes in 15-passenger vans were not wearing seatbelts. Seat belt use is especially critical because many people die in rollover crashes when they are partially or completely thrown from the vehicle. The risk of death or serious injury can be greatly reduced in a rollover crash by the use of seat belts.

Since most rollover crashes involve single vehicles they are often preventable.
NHTSA offers the following tips for drivers to minimize the risk of a rollover crash and serious injury or death:

1. Do not lose control. Avoid driving under the influence of drugs or alcohol. Avoid driving while tired. Slow down for adverse road and weather conditions.

2. Drive cautiously on rural or other roads that have unimproved shoulders. Be careful not to run off the road.

3. If your wheels drop off the roadway, or pavement, gradually slow down and steer back onto the roadway when it is safe to do so.

4. Maintain your tires. Keep tires are properly inflated with adequate tread. Bad tires cause your van to slide sideways on wet or slippery pavement. Improper inflation will cause handling problems and could cause catastrophic tire failures like blowouts.

5. When a 15-passenger van is not full ride in the seats in front of the rear axle.

6. Over 15 people should never be allowed to ride in a 15-passenger van.

On October 18, 2008, Chamberlin drank in a Lincoln Nebraska strip club, got into an argument with a Red Sox fan and then was stopped for speeding in his BMW.

In a November, 2008 news conference, Mark V. Rosenker, National Transportation Safety Board’s acting chairman, said that half of the country’s 17,000 alcohol related deaths in 2007 involved hard core drunk drivers.

Rosenker did not explain that alcohol related did not mean caused by an intoxicated driver.

Rosenker did not explain that the government has tried to conceal the actual 2007 death toll of 6,000 people, including drunk drivers, killed by drunk drivers.

NTSB has recommended eleven measures to stop drunk driving including regular sobriety checkpoints, lowering the blood alcohol content for a second offense and limiting plea bargains in DWI cases.

Rosenker did not explain that sobriety checkpoints impinge upon the liberty of innocent people while being one third as effective in stopping drunk drivers as roving patrols.

Rosenker did not explain how lowering the blood alcohol content for second offenders was necessary to stop hard core drunk drivers who drive with high BACs.

Rosenker did not explain how the Courts would handle trials for all DWI defendants when common sense negotiations were prohibited.

Virginia is one of five states that have adopted enough of the steps to be endorsed by NTSB.

Virginia Thurston, then 77 years old, an dementia patient, was sexually assaulted by 83 year old Ivy Edwards.

Edwards had 13 pages of criminal charges with 59 arrests, including child molestation and sexual assault.

One nursing home watchdog discovered 380 registered sex offenders living in nursing homes. That number did not include older felons and sex offenders like Edwards who were convicted before mandatory sex offender registration.

One Minnesota nursing home was closed after sex offenders transferred from prisons were discovered fondling, beating and sexually assaulting other residents.

This happens because of money – once the prisoners are placed in a nursing home Medicaid and Medicare pay the freight not the state bureau of prisons.

Colaj hit his brakes, lost control, and struck the left rear of Trooper D.W. Pruett's cruiser.

Trooper Pruett suffered minor injuries in the crash.

Colaj was charged with having no license and reckless driving.

Vernon Stevenson, an Austin Texas police officer, was suspended for 45 days after he registered a .224 and .226 on a breath tester following a DWI arrest.

Stevenson also agreed to be fired if he committed a similar offense with a year. He will also be subject to random alcohol testing for two years.

I am sure Stevenson deserves to keep his job; however, I wish the same consideration when to the mere citizens who get arrested for DWI even without .22 blood alcohol contents.

Cruz failed the unnatural roadside acts used by the police to demonstrate impaired driving even though such acts have nothing to do with driving.

Cruz allegedly passed gas after complaining that his asthma prevent him blowing in to the breath testing gadget.

"Here, put that in your Breathalyzer" is what Cruz claims he said.

Cruz was charged with battery on a police officer for his flatulance. Cruz was not charged for assaulting the machine.

Allen N. Panfile, 60, has been convicted six times of DUI since April, 2004.

Waynesboro Circuit Court Judge Humes J. Franklin, Jr. sentenced Panfile to 7 years in prison.

The prosecutor stated that Mr. Panfile had totally disrepected the law. I disagree, Panfile had disrepected himself.

Obviously Panfile has a problem; the issue is whether prison will address that problem or will Panfile become another catch and release alcoholic.

Panfile turned to the bottle after the deaths of eight family members since 2000 including, his Mom, Dad, brother and fiance.

No one was ever harmed in Panfile's DUI cases; Panfile suffers from heart problems.

Anthony F. Catroppa, a 65 year old Fayetteville, Arkansas bar owner was charged on September 26, 2008 with driving while intoxicated, refusing implied consent alcohol testing, careless driving, not having a motorcycle license and failing to yield to an emergency vehicle.

Catroppa was allegedly racing another motorcycle when stopped.

Catroppa claimed to have consumed two beers and could not stand on one foot because he had dropped a can on it earlier; he could not stand on the other because of gout.

Catroppa told the officer he would only consent to a blood test and the officer refused him.

Catroppa should have refused the unnatural acts performed at roadside; they are designed to fail the suspect.

Catroppa was probably right to want a blood test -- the problem is most states have now denied that choice to the citizen.

If Catroppa is too impaired to drive how can he operate a motorcycle at high speed?

Michael Louis Sparacino, a 51 year old North Mankako, Minnesota Hospital Doctor, was arrested for DWI while on his way to work.

Sparacino was arrested on May 15, 2008 for impeding traffic.

Zachary Jones, the 19 year old son of Charleston West Virginia Mayor Danny Jones was charged with DUI on September 28, 2008.

Jones crashed his car and then fled the scene.

Jones was later stopped by police and had glassy, bloodshot eyes with the odor of an alcoholic beverage present on his person.

Of course, odor does not prove intoxication and bloodshot eyes do not show impairment.

Glassy eyes also do not indicate impairment by alcohol or any other medium.

Jones failed the HGN eye test which few officers know how to give properly and has over 100 causes besides alcohol.

No one should take the unnatural roadside acts that pretend to show impairment by alcohol.

Jones got a break since leaving the scene might be a felony for someone not so well connected.

The "3-2 Rule"

Beating the Intoxilyzer

(or at least making sure it doesn't beat you.)

The above headline may be a little misleading. The last thing I want to do is to tell drunk drivers how to "beat" the Intoxilyzer. But I am tired of seeing the police misuse the Intoxilyzer to beat up on the citizenry. So the following advice is how to get the Intoxilyzer to measure exactly what it's supposed to measure: Your breath alcohol. And if it does that, you will probably be under the legal limit.

The police are trained to operate the Intoxilyzer. They take a 24 hour course, and are awarded a certificate that says that they are trained to be "breath test operators" under Florida law. I've taken that course, and have one of those certificates.

When the police are trained, they are instructed to tell the subject to "keep blowing until the tone stops." In reality, you cannot keep blowing until the tone stops. Why not? Because the tone doesn't stop until you are out of breath. It is a trick, to try to get you to blow out your deep lung air. Why are the police taught to do that? It turns out that the last fraction of a second of the breath is all that the Intoxilyzer measures.

Your "vital capacity" is the amount of air you can exhale from a full inward breath until you cannot blow any more. The lungs of a healthy human being have a typical "vital capacity" of around four and a half liters. That's 4,500 milliliters. The breath chamber of the Intoxilyzer 8000 is approximately 31 milliliters. In other words, the breath machine measures less than the last 1% of your breath. (Actually the last .6%)

They are measuring only the last 1% of your breath!. That would be fine if the last 1% were a representative sample of your breath alcohol.

But it's not.

The last 1% of your breath contains the highest alcohol concentration of your entire breath. By telling you to blow until you are out of breath, and measuring only the last 1%, the standard instructions for the Intoxilyzer can overestimate your breath alcohol by as much as 400%.

400%!

So how do you stop the police from overestimating your breath alcohol? Two steps. Remember this: Three and Two. That's the number "3" and then the number "2".

Step One. Take 3 deep breaths before you blow. If you hyperventilate three times before you blow into the machine, you will reduce your breath alcohol by as much as 55%. This occurs for two reasons. First, the breaths cool off your lungs. When the lung tissues are cooler, less alcohol goes from liquid form into vapor. The result is a lower breath alcohol. Second, the breaths clear out the alcohol from your lungs, filling them with fresh air. Find out more in this scholarly article.

(By the way, the reverse is also true. If you hold your breath for a few seconds before you blow, your breath alcohol will be increased. So whatever you do, DON'T HOLD YOUR BREATH before you blow into the machine!!)wo. Blow out HALF of your breath and STOP. Half of a breath is all that you need to give a valid sample under the Florida protocols. The Intoxilyzer 8000 requires only 1.1 liters of breath to register as "adequate volume." Blowing the minimum required can reduce your measurment by another 30%. How does it do that? By avoiding that alcohol-saturated "deep lung air" that the police are trained to test. The statutes do not tell them to test "deep lung air." The statutes tell them to test "breath." So why do they test "deep lung air" instead? Because that's whereeSo..... does this work?

I have personally, after a few drinks (all in the name of science, mind you) blown into an Intoxilyzer and obtained a reading of .099. That is over the legal limit. About three minutes later, I took my own advice and blew into the Intoxilyzer after three deep breaths. And blew only half of my breath. The result? A breath test reading of .028.

There you have it. The 3-2 Rule. You can blow an adequate sample under Florida law, and not allow the police to skew your sample so it looks higher than it really is. Sometimes blowing smart is a lot better than refusing to blow at all.

But even with all of this knowledge, the best way to avoid a DUI is not to drink and drive. Period.

Jeffrey David Pennaz, a Minneapolis police officer, was charged with driving while intoxicated on October 21, 2008

Officer Pennaz was stopped after motorists called 911 and reported a swerving motorist. Pennaz was found passed out at a traffic light.

Officer Pennaz had two children in his vehicle.

The arresting officers reported that Pennaz's eyes were bloodshot, watery and glassy and they detected a strong odor of an alcoholic beverage.

These officers apparently do not know that bloodshot, watery and glassy eyes are not NHTSA clues showing impairment by alcohol.

They also do not know that you cannot tell when, what, or how much from smell alone.

Oficer Pennaz refused the roadside exercises designed to make the subject appear impaired. Pennaz' breath tests showed a .21 grams per 210 liters result.

Pennaz has been with Minneapolis police since January, 2007.

Joseph Budge, a 61 year old taxi driver was arrested for DWI on October 23, 2008.

Budge was stopped by a Syracuse NY police officer who claimed that Budge had turned in front of a bus.

Budge apparently smelled of alcohol; a smell that Budge claimed came from a passenger.

Budge, like most people his age, failed the field sobriety test.

Budge has a blood alcohol level of .16 grams per 210 liters.

.16 should be falling down drunk; you would think that a falling down drunk Taxi driver would be more obvious than noted in this report.

My guess is that Budge's breath test was inflated by one of the medical conditions that can inflate the breath tester's report.

Bob Keefer also represents students at James Madison University JMU, Bridgewater College, Eastern Mennonite University EMU, and Blue Ridge Community College charged with alcohol offenses such as underage possession, DWI/DUI and possession of marijuana.

Apparently, Leyritz ran a red light as he reached for something inside his vehicle.

Leyritz's blood taken three hours after the collision registered .14 bac; the deceased's blood alcohol registered .18.

Leyritz is facing a maximum of 15 years in prison if convicted.

Martin DiCarlo, a 46 year old Austin, Texas man, was sentenced to another life term for his seventh DWI conviction.

DiCarlo was already on parole from a previous life sentence.

In October of 2007, DiCarlo was stopped in Austin and tested out to have a .139 blood alcohol content.

It is important to remember that years ago, when the intent was to arrest and convict only clearly impaired drivers, the legal limit was .15.

DiCarlo clearly has a problem with alcohol.

The state of Texas continues to catch and release him; some might say alcoholics like DiCarlo allow Texas to justify the tens of millions of dollars it spends annually n taxpayer money catching, stigmatizing, housing and releasing "drunk" drivers.

Wouldn't it be cheaper simply to assign a government employee to DiCarlo 24/7 to drive him around to work and therapy supporting himself?

I am sure that this new life prison term will "cure" DiCarlo just like his last life in prison term cured him.

It is the definition of insanity to continually do the same thing and expect a different result.

Andrea Osbourn, a 40 year old Denison Texas physical education teacher was released from jail on August 13, 2008 after serving her sentence for a 2007 DWI conviction.

Texas has a lifetime look back period so Ms. Osbourn's first DWI conviction 14 years ago was counted as a first offense.

Denison Superintendent Henry Scott said that Ms. Osbourn will probably be allowed to keep her job.

The public needs to understand that a DWI conviction can have life altering consequences.

Ms. Osbourn may have had a defense to that first DWI 14 years ago but decided it was more expedient to plead guilty.

These DWI convictions have such profound consequences that people should at least seriously consider fighting each and every charge.

It is not illegal to drive a car after consuming alcohol. It is illegal to drive a vehicle while impaired by alcohol or with a blood alcohol content of .08 or better.

.08 being the arbitrary number that was chosen by the federal goverment and then forced upon the states through withholding highway funds.

If this is the case why does the sign in center field in Capital Region, New York say "fans don't allow other fans to drink and drive".

Why do the police "storm out" on to the field at a Valley Cats game to make sure people don't drink and drive?

It is all about intimidation: when you think you are good with a hammer you see every problem as a nail.

We should all resent the government attitude that it is acceptable to threathen innocent citizens with force.

On August 2, 2008 Ryan Young, 20 years old, a Maryland Terrapin Lacrosse player, was arrested and charged with DWI.

Young who plays as an attackman, third on the Terps in points his freshman year, will automatically miss two games simply for being charged with DWI.

So much for being presumed innocent in Maryland when charged with DWI.

Senior Associated Athletic's Director Kathleen Worthington went so far as to say, "It doesn't matter how the case turns out; just putting yourself into a situation to be charged with it automatically triggers the suspension."

So if you are charged, even if you are innocent, you get punished simply for being charged.

Jarod Plummer, the 24 year old reliever for the Northwest Arkansas Naturals, was arrested by Fayetteville Arkansas police on August 6, 2008 for DWI.

Two of Plummer's teammates, Matt Peterson and Brian McFall, were present in the car but not arrested.

Plummer was released within a hour of being booked into the Washington County Detention Center.

Plummer was suspended for being charged; so much for the presumption of innocence, the foundation of our legal system.

Plummer is in the third season of his employment by the Kansas City Royals.

He advanced to Class AAA in 2007.

I hope Plummer gets a good lawyer and fights this charge. It would be a shame for a DWI to destroy his hopes at being a professional baseball player.

David Zimbler, the 37 year old Principal for Riverhead High School in New York state, was arrested on June 13, 2008 for DWI.

Zimbler was headed west on the Long Island Expressway when a Suffolk County Police Officer stopped him.

The Officer claims that Zimbler was swerving and failing to stay within his lane.

The Officer claims further that Zimbler had bloodshot eyes, slurred speech and smelled of alcohol.

The Officer did not explain how he could smell alcohol which has no detectable smell to humans.

The Officer also claimed that Zimbler failed a roadside gymnastics test and could not keep his balance.

Zimbler registered a .13 bac on the state's breath tester.

The School Board noted that it could not punish Zimbler since he had not yet been convicted.

Students have begun to ridicule Mr. Zimbler on Facebook and MySpace.

I hope Principal Zimbler gets himself a good lawyer to fight this charge although it seems that everyone wants punishment first, trial later.

Michael Rights, Southeast Supervisor, in New York received a DWI charge on July 20, 2008, his second DWI charge in 13 months.

Rights plead guilty to a DWI in which he crashed his Jaguar on Milltown road.

His second charge was on Route 22 when he was stopped for failing to dim his headlights.

Rights sugggest that his most recent arrest was a setup and that he was "railroaded and targeted by the Old Guard."

It is interesting that a politically connected person like Rights understand that DWI can be a useful tool in destroying someone's life.

Jevon "The Freak" Kearse, the 31 year old Defensive End for the Tennessee Titans, was arrested by Vanderbilt University Campus Police for DUI on June 22, 2008.

Kearse was stopped because of alleged swerving at a high rate of speed -- going at least 40 miles per hour in a 30 mile per hour zone.

It is alleged that Kearse had slurred speech, red eyes and smelled of alcohol. No explanation was given explaining how alcohol which has no odor was detected by sense of smell.

Kearse said he only had one Vodka and red bull; not too much alcohol for a man 6 foot 4, 265 pounds.

Jevon made the mistake of taking the field sobriety tests which are designed to fail the subject.

On July 12, 2008, a vehicle driven by Emily Vernon, Financial Director for Hernando County Sheriff's Department forced several vehicles off the road before hitting a road sign.

Deputies investigating the crash found Vernon to be acting erratically with an odor of an alcoholic beverage on her breath, an empty wine carafe in the passenger seat and a plastic bottle with a pink liquid that smelled like an alcoholic beverage.

Vernon apparently refused to make a statement that she was driving the vehicle and the deputies felt they could not make an arrest without evidence she was driving her car.

Vernon, like most people involved with law enforcement understands that talking to the police is simply stupid.

Vernon was charged ten days later when enough people complained.

The Sheriff talked about Vernon's medical problems.

"Folks make bad mistakes," "but obviously there's something going on, too."

I don't doubt that Ms. Vernon deserves a break; I just wish regular citizens would get the same break.

Chris Kearney, 20 year old UNC tennis star, was involved in an August 17th car crash in Hillsborough, North Carolina.

Kearney, 2007 Atlantic Coast Conference Freshman of the Year and 2008 member of the All-ACC team, apparently ran off Martin Luther King Boulevard shortly after 2AM.

Kearney's 2004 Nissan Murano struck to two UNC female students after bouncing off a stone wall.

The two female students were sent to N.C. Memorial Hospital.

Three Marines held Kearney until police arrived.

Kearney is charged with DWI, DWI by provisional licenee, reckless driving and two charges of possession of a fictitious license.

Kearney's blood alcohol content was .18.

Kearney has withdrawn from school.

Vernon Stevenson, an off duty Austin Texas Police Officer, was arrested on August 18, 2008 for DWI.

Officer Stevenson wrecked his personal motorcycle attracting the attention of an on duty police officer.

The Officer pulled Stevenson over as Stevenson attempted to leave the scene swerving between lanes.

The Officer noted that Stevenson's eyes were bloodshot and smelled alcohol on Stevenson's breath.

Stevenson refused a field sobriety test and was arrested for DWI. Stevenson was wise to refuse these tests -- they are designed to fail the subject.

Stevenson was the third Austin officer arrested for DWI this summer.

Ms. De Mornay had a .09 blood alcohol content and failed a field sobriety test.

She was placed on three years probation, ordered to successfully complete and three month alcohol education class and pay fines and court costs.

Retired New York State Trooper Frank Murray may not be facing charges in the death of the 90 year old pedestrian afterall.

A witness has come forward who says that the deceased was first struck by another vehicle and that impact threw the body against Murray's vehicle.

Murray denied drinking; refused a breath test; however the forced blood draw disclosed a .08 blood alcohol content for Murray.

Murray for some unknown reason attempted the field tests; tests designed to fail older folks like him.

Former Franklin Police Detective Edwin J. Delgado was found not guilty of perjury by a jury.

The crux of the case was testimony by Detective Delgado that he had calibrated his speedometer every six months.

He was unable to produce documentation supporting that testimony.

The Franklin Police Department was unable to even show what dates an officer drove a certain car.

The Franklin Police Department also exercised very little oversight to make sure the calibrations were done.

Andrea Sangermano is a diabetic who was wrongfully arrested for DWI/DUI in Nassau County.

Sangermano's photograph was placed on the County's website and Wall of Shame.

The problem with taking such actions before trial is you may be wrong.

In this case, Sangermano's poor driving was caused by complications with her Diabetes.

When she was pulled over after striking two cars Sangermano was unable to get out of her car or stand without help.

Sangermano's 0.00 breath test did not keep her from being arrested. Her negative for drugs urine test did not keep her from being arrested either.

Benjamin Beauchemin, a Hooksett Police Officer was found not guilty of DWI in Candida District Court on September 10, 2008.

Officer Beauchemin was off duty when he flipped his jeep.

He knew what to do:

1.    He told the eyewitnesses they did not need to call 911 since he was a police officer and he showed them his badge. (Buying time)

2.    He then quickly walked away to his girlfriend's house where he claimed to have guzzled four beers to calm his nerves after the crash. (Destroying the evidence of his blood alcohol content)

3.     He then returned after 10 or 15 minutes to the crash. (So as not to be hit and run)

4.     He refused to take the field tests. (Why give the government evidence against himself)

The Judge felt that he was displaying behavior not fitting for a police officer but he dismissed the case. The government could not prove he had been drinking to excess while driving the car.

Devin Head was not even supposed to be out when he was stopped with Ethan Adkins when Adkins was charged with DWI.

Adkins was indefinitely suspended.

James Burton Douglas, a 39 year old Hopewell resident has racked up two reckless driving charges along with a felony elude and a disregard highway sign.

On September 8, 2008, Trooper F.E. Boyd, Jr. attempted to stop Douglas for reckless driving on Interstate 95 near Petersburg.

Douglas did not stop; instead, he accelerated to over 100 mph, weaving between cars and driving on the shoulder.

Douglas was stopped by having his tires deflated by a strip placed by police.

Douglas suffered injuries and was removed to VCU Medical Center by LifeEvac helicopter.

Hamburg Town Police charged Ms. Adams with this offense after she failed the roadside gymnastic tests like the one leg stand.

Ms. Adams should have known to decline these voluntary tests designed to fail the subject.

The State's breath tester registered a .19.

Ms. Adams admitted to having three or four drinks. She should have known to ask for a lawyer and make no statements whatsoever.

Vernon Tiger Allen, a 43 year old Boston Firefigher was charged with drunk driving, speeding and negligence causing a car crash on September 14, 2008.

Allen's blood alcohol according to the state's breath tester was 0.14.

Allen, a Boston Firefighter since 1989, claimed that he had consumed two beers.

Ryan Surprenant, the other driver, was hospitalized in critical condition. Police say that he may be charged with running a red light and drunk driving as well.

We sometimes hear about law enforcement officers being arrested for DWI or DUI.

We do not usually hear about when they are stopped but not charged.

Sgt. Christopher D. Guerrero, an off duty Sacramento County Sheriff's Deputy was allowed to go home without being arrested when stopped by a Roseville policeman.

One allegation against Guerrero was that he had a blood alcohol of .16.

Two fellow deputies stopped behind the Roseville police car and threathened "war" between their departments unless Guerrero was released.

The state now plans a trial for Guerrero almost a year after he was stopped but not arrested. Good luck to them on winning that case without a evidentiary breath reading.

I am sure this Deputy deserved the break he received -- I just want the same break for the citizens that pay his salary.

Police had been chasing Shy for speeding on Rawley Pike before ceasing pursuit due to dangerous wet road conditions.

Lloyd Kinnear, the Canandaigua town supervisor, is going to litigate the felony DWI charge presently pending against him.

Since Kinnear was convicted of a DWI in 2005 under New York law this new charge constitutes a felony.
