

Q: I have been drinking. The Officer has stopped me. He obviously smells alcohol on my breath. He just asked me how much I have had to drink. What do I do?
A: Give the Officer your license and registration. Then tell him "I want a Lawyer. If I am not under arrest please let me go."
If he continues to ask you questions, Tell him again "I want a Lawyer. If I am not under arrest please let me go."
The point is that he is going to arrest you because you smell of alcohol. All you can do by talking and doing tests is building a case against yourself.
Be smart and tell the Officer I want a Lawyer. If I am not under arrest please let me go.
When the Officer asks you to stand on one leg, say your abcs, walk heel to toe or follow his light or pen with your eyes tell the Officer I do not consent to any tests except under DUI implied consent.
That means you do nothing in the field. You do not blow into the hand held breath tester. All you do is blow into the machine at the station that looks like a typewriter with a hose coming out of it or give blood.
