Criminal Refusal, driving on revoked and 2nd DUI within 5 years
Client was seen passed out in his vehicle in the middle of the road by 911 callers. Stopped by officer after being observed driving down the center line weaving from side to side.
Client fell out of car when stopped. Could not walk unassisted. Officer stated he was the drunkest person officer had ever seen. Asked not to do field tests because he said, "I am hammered." Client was still in VASAP for first DUI. Client was violating restricted license by driving at at time not permitted by his restricted license and driving while intoxicated.
Got refusal and driving revoked nol prossed, mandatory minimums for 2nd DUI within 5.
