Churchville DUI Lawyer Bob Keefer: Even substitute judges can be suspected of DWI DUI

Melvin Neisner, a 51 year old part time traffic Judge was suspended from that job due to charges that he lied to police and left the scene of an accident.

Judge Neisner swerved in front of a biker who collided with his vehicle suffering a broken leg.

Judge Neisner then drove off.

When police arrived at his home to investigate, Judge Neisner did not exercise his constitutional right not to talk with police as he should have.

Instead, according to police, Judge Neisner claimed his wife had been driving.

Neisner voluntarily took a preliminary breath test that showed over .12 BAC.

These preliminary breath test devices are not accurate; Judge Neisner should have known this and refused this voluntary test.

Judge Neisner then told the truth after his wife and children had been subpoenaed to testify at an inquest.

Based on Judge Neisner’s taped confession, prosecutors charged him with reckless driving, hit and run, lying to law enforcement and interefering with an investigation.

Judge Neisner said he left because he was afraid the biker would hurt him; the prosecutor believes that Judge Neiser fled the scene because he was drunk. 

Judge Neisner will probably lose his law license due to ethical dishonesty. 

Judge Neisner panicked and forgot that he did not have to talk with the police.
