- Bloodshot eyes are no longer considered to be a clue of impairment by alcohol. There are just too many other causes in the normal environment. See attachment E. page 10 of the NHTSA publication: "The Detection of DWI at BACs Below 0.10."
- Attached is a 2003 study called “Nystagmus Testing in Intoxicated Individuals”. Page 2, paragraph 6 reads: “Virtually all normal individuals can make smooth pursuit eye movements to track targets up to 30deg/sec…. If a target moves too quickly for the smooth pursuit system to track accurately, brief catch-up saccades will be interposed……and the eyes will been seen to jerk as they follow the stimulus.”

Massanutten DUI Attorney Bob Keefer: Even Judges get charged with Drunk in Public
Richard Sasso, a former New Jersey Municipal Judge in Warren, Bridgewater, Bound Brook and Watchung, is fighting ethics charges.
Judge Sasso resigned in January, 2008 citing health reasons about two months before the ethics complaint was brought.
Judge Sasso is charged with being under the influence while acting as Judge, imposing inappropriate fines on parties and counsel, imposing reduced fines on students and breaching the peace in a bar.
On two occasions Judge Sasso was accused of being so under the influence during court that he had slurred speech.
Judge Sasso claims that the slurred speech was due to Vicodin for knee and back problems as well as medicine for diabetes and high blood pressure.
Judge Sasso did admit that he also had wine with lunch on those occasions.
Judge Sasso also experiences sleep apnea which might cause slurred speech according to his attorney.
Judge Sasso also defended his actions in Torpedo's Go-Go Bar.
I am sure that Judge Sasso is right about his medication and sleep apnea causing his slurred speech; however, I wish regular citizens got the same benefit of the doubt.
