Lyndhurst Virginia VA DUI/DWI Lawyer Bob Keefer: Even Club Owners get charged with DUI/DWI

Anthony F. Catroppa, a 65 year old Fayetteville, Arkansas bar owner was charged on September 26, 2008 with driving while intoxicated, refusing implied consent alcohol testing, careless driving, not having a motorcycle license and failing to yield to an emergency vehicle.

Catroppa was allegedly racing another motorcycle when stopped.

Catroppa claimed to have consumed two beers and could not stand on one foot because he had dropped a can on it earlier; he could not stand on the other because of gout.

Catroppa told the officer he would only consent to a blood test and the officer refused him.

Catroppa should have refused the unnatural acts performed at roadside; they are designed to fail the suspect.

Catroppa was probably right to want a blood test -- the problem is most states have now denied that choice to the citizen.

If Catroppa is too impaired to drive how can he operate a motorcycle at high speed?

Justice White in United States v. Wade held:

But defense counsel has no comparable obligation to ascertain or present the truth. Our system assigns him a different mission. He must be and is interested in preventing the conviction of the innocent, but, absent a voluntary plea of guilty, we also insist that he defend his client whether he is innocent or guilty. The State has the obligation to present the evidence. Defense counsel need present nothing, even if he knows what the truth is. He need not furnish any witnesses to the police, or reveal any confidences of his client, or furnish any other information to help the prosecution's case. If he can confuse a witness, even a truthful one, or make him appear at a disadvantage, unsure or indecisive, that will be his normal course. Our interest in not convicting the innocent permits counsel to put the State to its proof, to put the State's case in the worst possible light, regardless of what he thinks or knows to be the truth. Undoubtedly there are some limits which defense counsel must observe but more often than not, defense counsel will cross-examine a prosecution witness, and impeach him if he can, even if he thinks the witness is telling the truth, just as he will attempt to destroy a witness who he thinks is lying. In this respect, as part of our modified adversary system and as part of the duty imposed on the most honorable defense counsel, we countenance or require conduct which in many instances has little, if any, relation to the search for truth.

Here is another great case dealing with cross-examination and the right to confer with counsel after direct exam is completed:

Perry v Leeke 488 US 272 (1998). The holding in Perry, supra, applies to all witnesses. As the US Supreme Court stated:

Accordingly, it is entirely appropriate for a trial judge to decide, after listening to direct examination of any witnesses, whether the defendant or a non defendant, that cross-examination is more likely to elicit truthful responses if it goes forward without allowing the witness an opportunity to consult with third parties, including his or her lawyer. . . [T]he truth-seeking function of the trial can be impeded in ways other than unethical "coaching." Cross-examination often depends for its effectiveness on the ability of counsel to punch holes in a witness' testimony at just the right time, in just the right way. Permitting a witness, including a criminal defendant, to consult with counsel after direct examination but before cross-examination grants the witness an opportunity to regroup and regain a poise and sense of strategy that the unaided witness would not possess. This is true even if we assume no deceit on the part of the witness; it is simply an empirical predicate of our system of adversary rather than inquisitorial justice that cross-examination of a witness who is uncounseled between direct examination and cross-examination is more likely to lead to the discovery of truth than is cross-examination of a witness who is given time to pause and consult with his attorney. Perry, supra, at 282.

Shenandoah County Virginia VA DUI Lawyer Bob Keefer: Even the Mayor's son can get charged with DUI/DWI

Zachary Jones, the 19 year old son of Charleston West Virginia Mayor Danny Jones was charged with DUI on September 28, 2008.

Jones crashed his car and then fled the scene.

Jones was later stopped by police and had glassy, bloodshot eyes with the odor of an alcoholic beverage present on his person.

Of course, odor does not prove intoxication and bloodshot eyes do not show impairment.

Glassy eyes also do not indicate impairment by alcohol or any other medium.

Jones failed the HGN eye test which few officers know how to give properly and has over 100 causes besides alcohol.

No one should take the unnatural roadside acts that pretend to show impairment by alcohol.

Jones got a break since leaving the scene might be a felony for someone not so well connected.

Sophia Santos, was sentenced October 1, 2008 to three to nine years in prsion for driving under the influence and killing another motorist.

In November, 2007, Santos ran a red light, struck another vehicle, killing one occupant and injuring three others.

Jose Santos, Sophia's father riding Funny Cide won the Kentucky Derby and the Preakness in 2003.

Santos was sentenced in Long Island's Nassau County Court.

Staunton Viriginia VA DUI DWI Lawyer Bob Keefer: Even Syracuse Lacrosse stars get charged with DUI DWI

Dan Hardy, Senior midfielder on Syracuse's National Championship Lacrosse team was charged with DUI on October 4, 2008.

Hardy was charged with running a stop sign, speeding and DWI with a blood alcohol level of above .08.

Hardy was honorable mention All-American in 2008; he scored 40 points.

Remember speeding is not a NHTSA clue for driving impaired by alcohol. Impaired drivers usually slow down. It is interesting to note that no other signs of impaired driving are alleged.

Staunton Virginia VA DUI DWI Lawyer Bob Keefer: Sometimes State Labs hide evidence in DUI DWI cases

Sandra Veiga, an inspector for the Florida Department of Law Enforcement, was fired in October of 2008 for destroying the evidence of breath tester failures.

Veiga was unplugging the gadget if the inspection was failing, then plugging it in to stop the gizmo from automatically reporting the failures.

Veiga was trying to hide the truth.

The FDLE has decided not to charge Veiga with any crimes.

Florida uses the Intoxilier 8000 to convict its citizens of DUI.

The "3-2 Rule"

(or at least making sure it doesn't beat you.)

The above headline may be a little misleading. The last thing I want to do is to tell drunk drivers how to "beat" the Intoxilyzer. But I am tired of seeing the police misuse the Intoxilyzer to beat up on the citizenry. So the following advice is how to get the Intoxilyzer to measure exactly what it's supposed to measure: Your breath alcohol. And if it does that, you will probably be under the legal limit.

The police are trained to operate the Intoxilyzer. They take a 24 hour course, and are awarded a certificate that says that they are trained to be "breath test operators" under Florida law. I've taken that course, and have one of those certificates.

When the police are trained, they are instructed to tell the subject to "keep blowing until the tone stops." In reality, you cannot keep blowing until the tone stops. Why not? Because the tone doesn't stop until you are out of breath. It is a trick, to try to get you to blow out your deep lung air. Why are the police taught to do that? It turns out that the last fraction of a second of the breath is all that the Intoxilyzer measures.

Your "vital capacity" is the amount of air you can exhale from a full inward breath until you cannot blow any more. The lungs of a healthy human being have a typical "vital capacity" of around four and a half liters. That's 4,500 milliliters. The breath chamber of the Intoxilyzer 8000 is approximately 31 milliliters. In other words, the breath machine measures less than the last 1% of your breath. (Actually the last .6%)

They are measuring only the last 1% of your breath!. That would be fine if the last 1% were a representative sample of your breath alcohol.

But it's not.

The last 1% of your breath contains the highest alcohol concentration of your entire breath. By telling you to blow until you are out of breath, and measuring only the last 1%, the standard instructions for the Intoxilyzer can overestimate your breath alcohol by as much as 400%.

400%!

So how do you stop the police from overestimating your breath alcohol? Two steps. Remember this: Three and Two. That's the number "3" and then the number "2".

Step One. Take 3 deep breaths before you blow. If you hyperventilate three times before you blow into the machine, you will reduce your breath alcohol by as much as 55%. This occurs for two reasons. First, the breaths cool off your lungs. When the lung tissues are cooler, less alcohol goes from liquid form into vapor. The result is a lower breath alcohol. Second, the breaths clear out the alcohol from your lungs, filling them with fresh air. Find out more in this scholarly article.

(By the way, the reverse is also true. If you hold your breath for a few seconds before you blow, your breath alcohol will be increased. So whatever you do, DON'T HOLD YOUR BREATH before you blow into the machine!!)wo. Blow out HALF of your breath and STOP. Half of a breath is all that you need to give a valid sample under the Florida protocols. The Intoxilyzer 8000 requires only 1.1 liters of breath to register as "adequate volume." Blowing the minimum required can reduce your measurment by another 30%. How does it do that? By avoiding that alcohol-saturated "deep lung air" that the police are trained to test. The statutes do not tell them to test "deep lung air." The statutes tell them to test "breath." So why do they test "deep lung air" instead? Because that's whereeSo..... does this work?

I have personally, after a few drinks (all in the name of science, mind you) blown into an Intoxilyzer and obtained a reading of .099. That is over the legal limit. About three minutes later, I took my own advice and blew into the Intoxilyzer after three deep breaths. And blew only half of my breath. The result? A breath test reading of .028.

There you have it. The 3-2 Rule. You can blow an adequate sample under Florida law, and not allow the police to skew your sample so it looks higher than it really is. Sometimes blowing smart is a lot better than refusing to blow at all.

But even with all of this knowledge, the best way to avoid a DUI is not to drink and drive. Period.

Harrisonburg DUI DWI Virginia VA Lawyer Bob Keefer: Even Kenny Stabler can beat a DWI charge with a good DUI Lawyer

Harrisonburg DUI DWI Virginia VA Lawyer Bob Keefer: Even Country Music Stars like John Michael Montgomery get charged with DUI DWI

John Michael Montgomery entered into a plea agreement from DUI charges in Lexington, Kentucky.

Montgomery's deal included the dismissal of possession of a controlled substance and possession of a concealed weapon.

Montgomery will have to complete an alcohol education course and his license will be suspended until he completes the course.

Montgomery was stopped after leaving a performance at the Austin City Saloon. Police claimed that he was seen swerving and running a red light.

Montgomery then failed an unnatural roadside exercise given by police to fail subjects and support their claim of impairment.

The police found two firearms and Valium in a bottle in Montgomery's vehicle. Montgomery's counsel indicated that he had permits for the firearms and the medication was for a hip replacment.

I am sure that having a recent hip replacement made standing on one leg and walking heel to toe poor ways of judging Montgomery's level of intoxication.

The case was sort of unusual. The arresting officer had listened to Montgomery and had made no attempt to stop him from driving. There were also problems with the way Montgomery's property was dealt with at the station.

The arresting officer was honored by fellow officers on a MySpace page for bagging a celebrity. The MySpace page included an altered picture of Montgomery.

In what eventually led to an internal police investigation regarding improper procedures, fellow police officers posted MySpace comments congratulating the arresting officer for the nabbing of a celebrity. An altered photo of Montgomery was also posted.

People need to understand that they are considered prey by law enforcement and act accordingly. Do not do the field tests; do not make any statements.

Harrisonburg DUI DWI Virginia VA Lawyer Bob Keefer: Even Minneapolis police officers get charged with DWI DUI

Jeffrey David Pennaz, a Minneapolis police officer, was charged with driving while intoxicated on October 21, 2008

Officer Pennaz was stopped after motorists called 911 and reported a swerving motorist. Pennaz was found passed out at a traffic light.

Officer Pennaz had two children in his vehicle.

The arresting officers reported that Pennaz's eyes were bloodshot, watery and glassy and they detected a strong odor of an alcoholic beverage.

These officers apparently do not know that bloodshot, watery and glassy eyes are not NHTSA clues showing impairment by alcohol.

They also do not know that you cannot tell when, what, or how much from smell alone.

Oficer Pennaz refused the roadside exercises designed to make the subject appear impaired. Pennaz' breath tests showed a .21 grams per 210 liters result.

Pennaz has been with Minneapolis police since January, 2007.

Woodstock Virginia VA DUI DWI Lawyer Bob Keefer: Even Cab drivers get charged with DUI DWI

Joseph Budge, a 61 year old taxi driver was arrested for DWI on October 23, 2008.

Budge was stopped by a Syracuse NY police officer who claimed that Budge had turned in front of a bus.

Budge apparently smelled of alcohol; a smell that Budge claimed came from a passenger.

Budge, like most people his age, failed the field sobriety test.

Budge has a blood alcohol level of .16 grams per 210 liters.

.16 should be falling down drunk; you would think that a falling down drunk Taxi driver would be more obvious than noted in this report.

My guess is that Budge's breath test was inflated by one of the medical conditions that can inflate the breath tester's report.

Ralph Larkin, a retired Los Angeles police officer, was arrested in May of 2008 on charges of possessing child pornography.

A year earlier Officer Larkin was tackled by the father of a fiver year old girl who realized Larkin was taking pictures of his daugher's genital area.

Police were able to restore some of the child pornography that former Officer Larkin had deleted prior to his arrest.
