Resendiz-Garcia was arrested for DUI in Rockingham County Virginia before escaping by assaulting a Virginia State Police Officer.

Spring Hill Virginia (VA) Lawyer Bob Keefer: West Virginia DWI/DUI Defendant charged with Battery on Police Officer for Passing Gas


Jose Cruz, 34 was stopped in Charleston West Virginia for driving without his headlights on.

Cruz failed the unnatural roadside acts used by the police to demonstrate impaired driving even though such acts have nothing to do with driving.

Cruz allegedly passed gas after complaining that his asthma prevent him blowing in to the breath testing gadget.

"Here, put that in your Breathalyzer" is what Cruz claims he said.

Cruz was charged with battery on a police officer for his flatulance.  Cruz was not charged for assaulting the machine.

These folks really take themselves pretty seriously.

Police Officer Eric Bittner, a Cumberland police officer entered a guilty plea in October of 2008 to driving while intoxicated.

Officer Bittner had charges of eluding police, driving in excess of reasonable speed, and driving under the influence dismissed.

Officer Bittner will keep his job; if only the citizens who pay his salary were treated as well.

Staunton Viriginia VA DUI DWI Lawyer Bob Keefer: Even Syracuse Lacrosse stars get charged with DUI DWI



Dan Hardy, Senior midfielder on Syracuse's National Championship Lacrosse team was charged with DUI on October 4, 2008.

Hardy was charged with running a stop sign, speeding and DWI with a blood alcohol level of above .08.

Hardy was honorable mention All-American in 2008; he scored 40 points.

Remember speeding is not a NHTSA clue for driving impaired by alcohol.  Impaired drivers usually slow down.  It is interesting to note that no other signs of impaired driving are alleged.

Staunton Virginia VA DUI DWI Lawyer Bob Keefer: Sometimes State Labs hide evidence in DUI DWI cases


Sandra Veiga, an inspector for the Florida Department of Law Enforcement, was fired in October of 2008 for destroying the evidence of breath tester failures.

Veiga was unplugging the gadget if the inspection was failing, then plugging it in to stop the gizmo from automatically reporting the failures.

Veiga was trying to hide the truth.

The FDLE has decided not to charge Veiga with any crimes.

Florida uses the Intoxilier 8000 to convict its citizens of DUI.

Harrisonburg DUI DWI Virginia VA Lawyer Bob Keefer: How to keep the Intoxilyzer from beating you


The "3-2 Rule"

or

Beating the Intoxilyzer

(or at least making sure it doesn't beat you.)

The above headline may be a little misleading.  The last thing I want to do is to tell drunk drivers how to "beat" the Intoxilyzer.  But I am tired of seeing the police misuse the Intoxilyzer to beat up on the citizenry.  So the following advice is how to get the Intoxilyzer to measure exactly what it's supposed to measure: Your breath alcohol.  And if it does that, you will probably be under the legal limit.

The police are trained to operate the Intoxilyzer. They take a 24 hour course, and are awarded a certificate that says that they are trained to be "breath test operators" under Florida law.  I've taken that course, and have one of those certificates.

When the police are trained, they are instructed to tell the subject to "keep blowing until the tone stops."  In reality, you cannot keep blowing until the tone stops.  Why not?  Because the tone doesn't stop until you are out of breath.   It is a trick, to try to get you to blow out your deep lung air.  Why are the police taught to do that? It turns out that the last fraction of a second of the breath is all that the Intoxilyzer measures. 

Your "vital capacity" is the amount of air you can exhale from a full inward breath until you cannot blow any more.  The lungs of a healthy human being have a typical "vital capacity" of around four and a half liters. That's 4,500 milliliters. The breath chamber of the Intoxilyzer 8000 is approximately 31 milliliters. In other words, the breath machine measures less than the last 1% of your breath.  (Actually the last .6%) 

They are measuring only the last 1% of your breath!.  That would be fine if the last 1% were a representative sample of your breath alcohol. 

But it's not.

The last 1% of your breath contains the highest alcohol concentration of your entire breath. By telling you to blow until you are out of breath, and measuring only the last 1%, the standard instructions for the Intoxilyzer can overestimate your breath alcohol by as much as 400%.

So how do you stop the police from overestimating your breath alcohol? Two steps. Remember this:  Three and Two.  That's the number "3" and then the number "2".

Step One. Take 3 deep breaths before you blow.  If you hyperventilate three times before you blow into the machine, you will reduce your breath alcohol by as much as 55%. This occurs for two reasons.  First, the breaths cool off your lungs.  When the lung tissues are cooler, less alcohol goes from liquid form into vapor.  The result is a lower breath alcohol.  Second, the breaths clear out the alcohol from your lungs, filling them with fresh air.  Find out more in this scholarly article.  

(By the way, the reverse is also true.  If you hold your breath for a few seconds before you blow, your breath alcohol will be increased.  So whatever you do, DON'T HOLD YOUR BREATH before you blow into the machine!!)wo.  Blow out HALF  of your breath and STOP.  Half of a breath is all that you need to give a valid sample under the Florida protocols.   The Intoxilyzer 8000 requires only 1.1 liters of breath to register as "adequate volume."  Blowing the minimum required can reduce your measurment by another 30%. How does it do that?  By avoiding that alcohol-saturated "deep lung air" that the police are trained to test.  The statutes do not tell them to test "deep lung air."  The statutes tell them to test "breath."  So why do they test "deep lung air" instead?  Because that's whereeSo..... does this work?  

I have personally, after a few drinks (all in the name of science, mind you) blown into an Intoxilyzer and obtained a reading of .099.  That is over the legal limit.  About three minutes later, I took my own advice and blew into the Intoxilyzer after three deep breaths.  And blew only half of my breath.  The result?  A breath test reading of .028.

There you have it.  The 3-2 Rule.   You can blow an adequate sample under Florida law, and not allow the police to skew your sample so it looks higher than it really is.  Sometimes blowing smart is a lot better than refusing to blow at all.

But even with all of this knowledge, the best way to avoid a DUI is not to drink and drive.   Period.

On October 20, 2008, Marcus Vick, former Virginia Tech and NFL football player, was convicted of driving under the influence of alcohol (DUI).

The Court also convicted Vick of driving on the wrong side of the road and eluding police.

Vick was given a 12 month suspended jail sentence and a fine.

Harrisonburg DUI DWI Virginia VA Lawyer Bob Keefer: Even Kenny Stabler can beat a DWI charge with a good DUI Lawyer



Mark Polson, a very talented attorney and fellow member of the National College for DUI Defense (NCDD) was faced with a very challenging case:  defending Kenny Stabler who had been convicted twice before of DUI.

Stabler, played for the
University of Alabama before starting his 14-year NFL career as a quarterback for the Oakland Raiders, Houston Oilers and New Orleans Saints.

In June, 2008 Stabler was stopped for swerving in his lane in
Robertsdale.

Polson pointed out that Stabler's football career cost him four knee operations.

Stabler's doctor testified Stabler had arthritis.

Stabler refused to take the field tests.

Harrisonburg DUI DWI Virginia VA Lawyer Bob Keefer: Even Minneapolis police officers get charged with DWI DUI


Jeffrey David Pennaz, a Minneapolis police officer, was charged with driving while intoxicated on October 21, 2008

Officer Pennaz was stopped after motorists called 911 and reported a swerving motorist.  Pennaz was found passed out at a traffic light.

Officer Pennaz had two children in his vehicle.

The arresting officers reported that Pennaz's eyes were bloodshot, watery and glassy and they detected a strong odor of an alcoholic beverage.

These officers apparently do not know that bloodshot, watery and glassy eyes are not NHTSA clues showing impairment by alcohol.

They also do not know that you cannot tell when, what, or how much from smell alone.

Oficer Pennaz refused the roadside exercises designed to make the subject appear impaired.  Pennaz' breath tests showed a .21 grams per 210 liters result.

Pennaz has been with Minneapolis police since January, 2007.

Woodstock Virginia VA DUI DWI Lawyer Bob Keefer: Even Cab drivers get charged with DUI DWI



Joseph Budge, a 61 year old taxi driver was arrested for DWI on October 23, 2008.

Budge was stopped by a Syracuse NY police officer who claimed that Budge had turned in front of a bus.

Budge apparently smelled of alcohol; a smell that Budge claimed came from a passenger.

Budge, like most people his age, failed the field sobriety test.

Budge has a blood alcohol level of .16 grams per 210 liters.

.16 should be falling down drunk; you would think that a falling down drunk Taxi driver would be more obvious than noted in this report.

My guess is that Budge's breath test was inflated by one of the medical conditions that can inflate the breath tester's report.

Ralph Larkin, a retired Los Angeles police officer, was arrested in May of 2008 on charges of possessing child pornography. 

A year earlier Officer Larkin was tackled by the father of a fiver year old girl who realized Larkin was taking pictures of his daugher's genital area.

Police were able to restore some of the child pornography that former Officer Larkin had deleted prior to his arrest.
