Newport News Police Captain Dawn D. Barber was given a 30 day suspended jail sentence, a one year restricted license and a $250 fine along with VASAP classes.
Police Captain Barber nearly struck a car on Interstate 64 before being charged with DUI and reckless driving by a Virginia State Trooper.
Captain Barber performed poorly on the roadside agility exercises designed to make anyone look impaired.
Captain Barber also blew a .12 BAC on the “dated, unstable and unreliable” breath testers used to provide evidence against Virginia motorists.
According to one newspaper article, Captain Barber asked to reduce her DUI to reckless driving but the Court would not accept the deal.

Mark Thomas Strickland, Poquoson High School wrestling coach, was arrested in November, 2008 for DUI and drug possession.
Coach Strickland was arrested in the driveway of his home after being stopped for driving 48 in a 25 mile per hour zone.
Coach Strickland apparently agreed to take the unnatural roadside act exercises designed to make one appear impaired.
Coach Strickland was deemed to have failed such testing as most people who take such exercises do.
Coach Strickland, in addition to DUI, was charged with refusal to take a breath test, reckless driving, possession of marijuana, possession of drug paraphernalia and open container.
Coach Strickland is in his second year as wrestling coach at Poquoson.
Coach Strickland was a two time state champion wrestler at Chesapeake’s Great Bridge High School and was considered for the 2000 U.S. Olympic Team.
Coach Strickland is no longer Coach at Poquoson.

Peter Tourison, the Municipal Court Judge for Cape May, Stone Harbor and Middle Township pled guilty to a DWI on June 25, 2008.
Judge Tourison was arrested for DWI on March 27, 2008 after crashing into another car in a Wawa parking lot.
Judge Tourison made the mistake of taking a field sobriety test. These tests are designed to fail the subject.
Judge Tourison registered a .08 BAC on the breath tester.

James C. Joiner, the 47 year old principal of Fall Creek Valley Middle School in Lawrence was arrested on November 8, 2008 for a second DWI charge within three months.
Principal Joiner was arrested after he ran over a fire hydrant.
Joiner had a reported blood alcohol level of 0.14.
I assume that Principal Joiner will be given a good deal due to his employment by the state; I am sure he deserves that good deal; I just wish regular citizens were considered for such breaks.

Keenan Gilligan, a 27 year old Norfolk police officer was convicted on November 14, 2008 of DUI.
Officer Gilligan also had a refusal charge which was taken under advidement until December 4, 2008.
A refusal charge typically carries with it a loss of license of one year without the chance of a restricted license.
It appears that Officer Gilligan may have gotten a break on the refusal; I am sure deserves that break; I just wish that ordinary citizens received the same consideration.
Officer Gilligan was arrested after a one car accident and apparently refused the breath test after being arrested.

Annette Griffin, Superintendent for Carrollton-Farmers Branch schools has been charged with driving while intoxicated DWI.
Superintendent Griffin will probably be fired by the school board on December 4, 2008.
The school board has even removed her profile from the website.
Superintendent Griffin will lose her $285,000 salary not counting benefits when she is terminated.
Superintendent Griffin has been on paid leave since October 9, 2008.
Griffin was arrested at a Dallas/Fort Worth International toll booth for DWI. Her reported blood alcohol content was 0.19. Maybe it was even correct.
Dr. Griffin has not been convicted of DWI; but she is getting fired just as if she had.
Dr. Griffin was Texas Superintendent of the year in 2000.
What a rush to justice.

Virginia is now or will soon be replacing its “dated, unstable and unreliable” Intoxilyzer 5000s.
Virginia’s Department of Forensic Science has always maintained to the public that these gadgets will know they are making a mistake and not give an incorrect result.
In other words, a perfect machine that never makes mistakes!
That of course, is impossible; there is no perfect machine.
Internally, the Department of Forensic Science complains about increasing instrument failures and its inability to find replacement parts.
In any event, in July, 2008 a suspect was tested on SN68-001998, the Intoxilyzer 5000 in the Rockingham County, Virginia Sheriff’s Department.
The breath test result was .60 BAC.
Two hours and two minutes the subject’s blood test showed her true BAC, 0.00; no alcohol whatsoever.
The ultimate False Positive. These gadgets are dated, unstable and unreliable just like the Department of Forensic Science has been saying since 2005.
